This is a convenience translation of the German original. In case of doubt, the German version applies.
The most important points first: We do not set any cookies and do not load anything from third-party servers. We only count anonymously and without cookies, using software that we run ourselves, how many people visit the site; you can object to this. You do not need to log in. You only give a nickname if you want to, and it then appears publicly in the leaderboard.
1) Introduction and contact details of the controller
1.1 We are pleased that you are visiting our website and thank you for your interest. Below we inform you about how we handle your personal data when you use our website. Personal data means all data with which you can be personally identified.
1.2 The controller for data processing on this website within the meaning of the General Data Protection Regulation (GDPR, in German: DSGVO) is Jochen Kächelin, Messelbergstr. 8, 73066 Uhingen, Deutschland, phone: +49 (0)7161 5071373, e-mail: info@jochenk.com. The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data.
2) Data collection when you visit our website
2.1 When you use our website for information only, that is, when you do not register or otherwise send us information, we only collect the data that your browser transmits to the web server (so-called “server log files”). When you access our website, we collect the following data, which is technically necessary for us to display the website to you:
- Our website that you visited
- Date and time of access
- Amount of data sent in bytes
- Source/referrer from which you reached the page
- Browser used
- Operating system used
- IP address used (if applicable, in anonymised form)
The processing takes place pursuant to Art. 6(1)(f) GDPR (DSGVO) on the basis of our legitimate interest in improving the stability and functionality of our website. The data is not passed on or used in any other way. However, we reserve the right to review the server log files retrospectively if concrete indications point to unlawful use.
2.2 For security reasons and to protect the transmission of personal data and other confidential content, this website uses SSL or TLS encryption. You can recognise an encrypted connection by the string “https://” and the lock symbol in your browser bar.
2.3 Beyond the server log files mentioned above, we collect only what is described in sections 7 to 11 when you visit and play. We do not combine the server log files with this game data.
3) Hosting & content delivery network
To host our website and display its content, we use Hetzner Online GmbH, Industriestr. 25, 91710 Gunzenhausen, Germany. The server is located in a data centre in Falkenstein, Germany; the services are provided exclusively on servers within the European Union.
All data collected on our website is processed on these servers, unless other recipients are named below for specific data processing.
We have concluded a data processing agreement with the provider, which ensures the protection of our website visitors’ data and prohibits unauthorised disclosure to third parties.
We do not use a content delivery network. Fonts, stylesheets, scripts, images, the map and our game code are delivered exclusively from our own servers; Google Fonts or comparable services are not embedded. In doing so, your IP address goes to nobody but us and our hosting provider.
4) Cookies and local storage
This website does not set any cookies of its own accord. The game works entirely without them. There is no login, no advertising network and no embedded content from social networks.
In your browser’s storage (in what is called Local Storage) we store three values at most:
- The nickname you entered last, so that you do not have to type it again in the next round.
- Whether the sound is on or off.
- The language in which you last used the site (German or English). The language is determined solely by the address (English is under /en), not by a cookie.
These values do not leave your device and are not transmitted to us. They are strictly necessary for the functions you request (§ 25(2) no. 2 TDDDG, the German Telecommunications Digital Services Data Protection Act) and therefore do not require consent. You can delete them at any time via your browser settings.
If you object to the reach measurement (section 6), a single cookie records exactly this objection.
You can set your browser so that you are informed about the setting of cookies and can decide individually whether to accept them, or exclude the acceptance of cookies for certain cases or in general. That is why you do not have to confirm a cookie banner with us either.
5) Contacting us
There is no contact form on this website. When you contact us by e-mail, personal data is collected, namely the information you provide yourself in your message. This data is stored and used exclusively for the purpose of answering your enquiry or for contacting you and the associated technical administration.
The legal basis for processing this data is our legitimate interest in answering your enquiry pursuant to Art. 6(1)(f) GDPR (DSGVO). If your contact aims at concluding a contract, the additional legal basis for the processing is Art. 6(1)(b) GDPR (DSGVO). Your data will be deleted after your enquiry has been processed to a conclusion. This is the case when it can be inferred from the circumstances that the matter in question has been finally clarified, and provided that no statutory retention obligations prevent this.
6) Web analytics services
Matomo
This website uses a web analytics service from the following provider: InnoCraft Ltd., 150 Willis St, 6011 Wellington, New Zealand (“Matomo”).
We operate Matomo exclusively self-hosted on our own servers within the European Union. The measurement data does not leave our servers: the provider receives no data whatsoever about your visit, and no transfer to New Zealand or any other third country takes place.
To protect website visitors, Matomo uses a so-called “config_id” to enable different analyses of site usage within a short time window of up to 24 hours. The “config_id” is a randomly set, time-limited hash of a limited set of settings and attributes of the visitor. The config_id or config hash is a string calculated for a visitor on the basis of their operating system, browser, browser plug-ins, IP address and browser language. Matomo does not use device fingerprinting and uses an anonymised IP address of the site visitor to create the “config_id”.
The measurement works without cookies: for this purpose nothing is stored on or read from your device. If your browser transmits the “Do Not Track” setting, no measurement takes place at all. From your results page, the measurement learns neither the identifier in the web address nor your nickname or your points; it only counts the page view.
Insofar as the information processed in this way includes personal user data, the processing takes place pursuant to Art. 6(1)(f) GDPR (DSGVO) on the basis of our legitimate interest in the statistical analysis of user behaviour for optimisation and marketing purposes, in order to improve the game and to be able to show sponsors the reach. To object to the processing of your visitor data for the future, we provide a separate objection option on our website:
Objection to audience measurement
Your objection is recorded in a single cookie on your device – it only contains the information that you objected. If you delete your cookies or switch browser or device, you have to declare it again.
No audience measurement is currently active on this page – so no data about your visit is collected that you would have to object to.
Because we operate the service ourselves, a data processing agreement with the provider is not required: it does not process any data for us. For the same reason, no legal basis for a transfer of data to a third country is needed.
7) What happens when you play?
7.1 When you press “Go!”, the server creates a round: the three cities, the start time, the pins you have placed (coordinates), the calculated distances and your points. For this we store a random identifier of the round, but no IP address and no information about your device. We therefore cannot attribute the round to you personally as long as you do not give a nickname. The legal basis is the carrying out of the game that you expressly use (Art. 6(1)(b) GDPR (DSGVO)).
7.2 We delete rounds that you do not finish (tab closed, phone put away) after one day. Finished rounds remain stored so that they can appear in the leaderboard and on the results page; how long is stated in section 13.
8) Your nickname, the leaderboard and the results page
8.1 Voluntary, and not a real name. You do not have to give a nickname; without one you play anonymously and do not appear in any leaderboard. If you enter one (2 to 16 characters: letters, digits, spaces and . _ - !), please choose a nickname and not your real name. It should not make you directly identifiable, and you should not use the name of another person. A list of impermissible words checks the entry automatically; we hide entries that violate the rules.
8.2 Where it appears. Your nickname appears publicly together with your points, your title, the three cities of your round and your rank
- in the leaderboard (today, this week, all time) and in the ranking of the daily challenge,
- on your results page, which has its own address with a random identifier (without a map and without coordinates),
- in the image and in the text if you pass on your result via “Share” or “Save image” (section 10),
- in the image on our channels, but only if you expressly confirm this when submitting (section 11).
8.3 Public means public. Anyone who knows the address can open the leaderboard and every results page without logging in. Others can copy content, save it as a screenshot or pass it on, and search engines can include public pages. We cannot retrieve what others have taken over in this way. Nicknames are not unique: several people can use the same nickname, so it proves nothing about the person behind it. In our database the nickname is stored only together with the round (section 7), not with an IP address, device information or an account.
8.4 Legal basis and withdrawal. The legal basis is your consent through the voluntary entry (Art. 6(1)(a) GDPR (DSGVO)). You can withdraw it at any time with effect for the future: send us an e-mail to info@jochenk.com with the link to your results page, and we will remove the nickname or the entry from the leaderboard and from the results page. How long the nickname is otherwise stored is stated in section 13.
9) Daily challenge and sponsors
In the daily challenge, everyone gets the same three cities on a given day. The round is stored like any other (see section 7) and assigned to the ranking of the challenge. Some days are presented by a sponsor. This is labelled “Ad”. Advertising exists only as a labelled sponsor notice, without an advertising network and without tracking. If you click a sponsor link, we count the click in our database (only the identifier of the sponsor, the date and the number: no IP address, no information about you, no cookies) and redirect you. After that you are on the sponsor’s site, where its privacy policy applies. Logos and texts of the sponsors are located on our server, nothing is loaded from the sponsor’s servers when you access our site. The server log files (section 2) contain the access to the link like any other access. We count in order to be able to show sponsors the reach (legitimate interest, Art. 6(1)(f) GDPR (DSGVO)).
10) Sharing your result
10.1 The image for “Share” and “Save image” is generated by your browser on your device: it shows your points, your title and the three cities, no map and no coordinates. Your nickname and your rank appear in it only if you have entered a nickname. You see the image in a preview beforehand. “Save image” only stores the file on your device.
10.2 Sharing also creates a text with your points (and, if present, your nickname) and a link to your results page. This link contains only the random identifier of the results page. Whoever opens it sees the public results page (section 8); on our side this creates the server log files (section 2).
10.3 The image and the link do not go anywhere until you yourself pass them on via your device’s share menu to an app of your choice (for example Instagram, TikTok or WhatsApp). This transmission takes place outside our website, via the service you have chosen and under its terms. From then on, the data protection provisions of that provider apply. We transmit nothing in doing so, we do not learn whether or where you have shared, and we do not connect to your accounts on social networks.
11) “Show on Peter’s channel” (voluntary)
After the game you can submit your result for publication on the Instagram and TikTok channels of Peter The Pin. This is voluntary and only possible with your express consent (Art. 6(1)(a) GDPR (DSGVO)). For this we store the result image (points, cities, distances, no map), whether your nickname may be mentioned, the time of your consent and the version of the consent text. The default is anonymous: then neither your nickname nor your rank appears in the image. We show you with a nickname only if you have entered a nickname and confirm that you are at least 16 years old or have your parents’ consent.
We review every submission by hand and post it ourselves: nothing is published automatically, and we do not connect to your accounts. We delete a submission that we do not process after 30 days, a rejected one after 7 days. Published posts remain on our channels until you withdraw your consent.
Withdrawal: As long as you have the result open, you can withdraw the submission with one click. After that, and for posts that have already been published, an e-mail to info@jochenk.com with the link to your results page is enough; we will then delete the post from our channels. We cannot retrieve copies or forwards that others have made. On Instagram and TikTok, the data protection provisions of the operators of these platforms (Meta, TikTok) also apply; they may also process data outside the EU.
In the footer of our site we link to our profiles on Instagram and TikTok. These are plain links: nothing is loaded from these platforms when you open our site, and data only goes to them once you click a link. From then on, the data protection provisions of the respective platform apply.

12) Rights of the data subject
12.1 Applicable data protection law grants you the following data subject rights (rights of access and intervention) against us as the controller with regard to the processing of your personal data; for the respective conditions of exercise, reference is made to the legal basis cited:
- Right of access pursuant to Art. 15 GDPR (DSGVO);
- Right to rectification pursuant to Art. 16 GDPR (DSGVO);
- Right to erasure pursuant to Art. 17 GDPR (DSGVO);
- Right to restriction of processing pursuant to Art. 18 GDPR (DSGVO);
- Right to notification pursuant to Art. 19 GDPR (DSGVO);
- Right to data portability pursuant to Art. 20 GDPR (DSGVO);
- Right to withdraw consent given pursuant to Art. 7(3) GDPR (DSGVO);
- Right to lodge a complaint pursuant to Art. 77 GDPR (DSGVO).
12.2 Right to object
If we process your personal data on the basis of our overriding legitimate interest within the framework of a balancing of interests, you have the right to object to this processing at any time, with effect for the future, on grounds relating to your particular situation.
If you exercise your right to object, we will stop processing the data concerned. However, we reserve the right to continue processing if we can demonstrate compelling legitimate grounds for the processing that override your interests, fundamental rights and freedoms, or if the processing serves the establishment, exercise or defence of legal claims.
If we process your personal data for direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing. You can exercise the objection as described above.
If you exercise your right to object, we will stop processing the data concerned for direct marketing purposes.
Irrespective of this, you have the right to lodge a complaint with a data protection supervisory authority. The authority responsible is Der Landesbeauftragte für den Datenschutz und die Informationsfreiheit Baden-Württemberg (the State Commissioner for Data Protection and Freedom of Information of Baden-Württemberg), Lautenschlagerstraße 20, 70173 Stuttgart.
13) Duration of storage of personal data
The duration of storage of personal data is determined by the respective legal basis, by the purpose of processing and, where applicable, additionally by the respective statutory retention period.
- We delete rounds that were not finished after one day.
- Finished rounds including the nickname remain in the leaderboard and on the results page until you ask for their removal (section 8.4).
- Submissions for our channels that we do not process are deleted after 30 days, rejected ones after 7 days; published posts remain until you withdraw your consent.
- The counters of sponsor clicks contain no information about you and remain stored as numbers.
Where personal data is processed on the basis of express consent pursuant to Art. 6(1)(a) GDPR (DSGVO), the data concerned is stored until you withdraw your consent.
Where personal data is processed on the basis of Art. 6(1)(f) GDPR (DSGVO), this data is stored until you exercise your right to object pursuant to Art. 21(1) GDPR (DSGVO), unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.
Unless the other information in this policy on specific processing situations provides otherwise, stored personal data is otherwise deleted when it is no longer necessary for the purposes for which it was collected or otherwise processed.
